All bookings with Surfers Paradise Cruises are subject to our Terms and
Conditions of Booking, Disclaimer / Exclusion of Liability, and Privacy
Statements.
Please note you must be over 18 to book a charter.
By definition the “charterer” is the organiser of the cruise be it an
individual, individuals, group, company – or other association, or a group of
people, of whatever description. Whereas the “boat supplier” is Party Cruise (Qld) Pty
Ltd ABN 75 120 491 625 of Gold
Coast QLD.
In making final payment for your charter boat, catering, bar and / or
entertainment options, as displayed on this site or arranged otherwise prior to
commencement of the charter you accept the following Terms and Conditions:
General conditions of booking:
- Charters cannot be booked on
Saturday nights due to our permanent Party Cruise - as seen on the home
page.
- Charters
will be confirmed upon receipt of payment and the boat will be held in the
name of the individual charterer or group.
- The
confirmation will detail the legal relationship between the charterer and
the boat supplier.
- After
the initial Confirmation of Charter, and usually within 14 days, the boat
supplier will contact the charterer and provide additional information
related to the charter - such as extra services and “tailoring” of your
charter to suit the occasion.
- For
your comfort it may be necessary to amend itineraries or arrangements due
to either weather or other operational needs. The boat supplier reserves
the right to vary itineraries, schedules and conditions of cruise without
notice.
- As
a general rule cash payment on embarkation is not permitted unless prior
arrangements have been made. If paying by cheque it must be received 10 days prior
to departure to ensure funds have been processed.
- Government
regulations prohibit smoking within the interior cabin areas of the boat.
Surfers Paradise Cruises provide experienced crew
to drive and manage the vessel throughout the charter. Tables and chairs are
included and optional extras are available. These include bar packages, DJ and entertainer.
Inclusions:
- Use
of the vessel for the stipulated 3 or 4 hours. The charter price is for 3
hours. Each additional hour incurs a cost to be determined by Surfers
Paradise Cruises.
- Access
to the vessel no more than 1 hour prior to vessel departure for decorating unless prior arrangements have been made.
Cleaning:
- Charters include a cleaning charge to clean the vessel’s public areas.
- For
every charter security guards must be hired for the cruise (2 included additional
cost applies if over 100 passengers).
Bar Service:
- Surfers
Paradise Cruises is a licensed venue and will supply all alcoholic
beverages (additional costs apply).
- No
alcohol is to be brought on board by the Charterer or their guests.
- Responsible
Service of Alcohol is always adhered to and we reserve the right to refuse to serve intoxicated
persons.
Underage Guests:
It is the charterer's responsibility to advise of underage guest
numbers. Underage guests are permitted on board, however ID will be checked on
arrival and a wristband system will ensure we distinguish between overage and
underage guests. There is an extra fee of $50.00 for the purchase of our
wristbands. If any underage passengers are seen consuming alcohol Surfers Paradise Cruises will terminate the charter immediately with no refund to the charterer.
Payment Schedule:
Charters:
- A
$500 deposit and a copy of the signed contract is required to confirm your
booking. This is required 7 days after you receive the contract.
- A
bond to be determined by Surfers Paradise Cruises is payable prior to the charter and will be refunded
following the cruise (conditions apply).
- At
the conclusion of the cruise an inspection of the vessel will be carried
out with the Charterer and any damage to the vessel will be deducted from
the bond.
Catered Charters:
- While
Surfers Paradise Cruises supports catered functions it does not provide
the catering
- All
catering is to be organized by the charterer- preferred caterers phone
numbers will be supplied by Surfers Paradise Cruises.
All Charters:
- All
prices are in Australian Dollars and include Australian Goods &
Services Tax (GST 10% as at March 2007)
- Prices
are subject to alteration without notice, however prices and rates as
detailed on the confirmation will remain firm if not altered by the Boat
Supplier sixty days prior to the date of the function.
- Confirmation
of final passenger numbers and settlement of account in full must be made
7 working days prior to the function.
- In
the event that the operator fails to carry out the specific services
monies will be refunded accordingly either in full or in part.
- Your
function will only proceed if full payment is received 7 working days
prior to your function.
- Credit
card processing fees apply to all bookings as follows:
- Mastercard
and Visa – 2%
- Amex
and Diners – 3%
Cancellation
Policy:
Cancellation of a function due to any reason, not the fault of the
operator, will result in cancellation charges as follows:
- Up
to 31 days prior - 20% of total charter fee.
- Within
30 days to 7 working days prior - 50% of total charter fee.
- 7
working days or less - 100% of total charter fee.
IMPORTANT INFORMATION - DISCLAIMER / EXCLUSION OF LIABILITY
- Whilst
the boat supplier will take all responsible steps to provide an enjoyable
charter and entertainment, it accepts no liability for any loss of
enjoyment experienced by participants due to circumstances beyond its
control. The boat supplier further accepts no liability for any loss
beyond its reasonable control and provides no warranties in addition to
those set out in the Trade Practices Act 1974, and nothing herein
restricts the charterer or individual guest of the charterer, from
exercising their rights and remedies pursuant to law.
- There
is no liability by the boat supplier until the boat supplier notifies the
participant (by way of a booking confirmation and / or confirmation of
payment advice) that moneys have been received by the boat supplier.
- The
boat supplier, in some instances, will only act as agent, of any
component/s of the charter. Whilst the boat supplier takes all reasonable
care in selecting these other suppliers of boats or services (components)
it cannot accept responsibility for these other suppliers conduct or the
conduct of their representative/s, employees, and agents, or any
ramifications of that conduct.
- The
sub contractors of services (e.g. entertainment providers), maintain their
own Responsibility and Liability conditions and a copy of same will be
available to charterers, or individual guests of the charterer, on request
and before commencing of the charter.
- The
boat supplier reserves the right to exclude a person from participating in
a charter, either before commencement or during the charter, if a person
has a mental or physical condition which is, in the opinion of any
representative of the boat supplier, such as to render them incapable of
caring for themselves, or whereby they become objectionable to other
onboard guests or crew members, or they become a hazard to themselves or
other guests or onboard crew members.
- The
boat supplier and / or its representative/s, will not be responsible for
expenses resulting in such persons being precluded from participating in
the charter, or completing the charter as booked by the charterer.
- Whilst
it is unlikely the cruising itinerary will change, the boat supplier
reserves the right to make alterations without notice. Alterations may be
due to strikes, weather conditions, exclusion zones, bushfires, local
festivals, acts of nature, or other reasons.
- Whilst
every effort is made to ensure on time departure the boat supplier is
unable to guarantee the exact departure (and return) times of any charter,
and are not to be held liable for any missed connections nor any expense
involved with delays.
